Present application has been filed on behalf of the plaintiffs under Order XXXIX Rules 1 & 2 of CPC , 1908 seeking ex-parte ad-interim injunction against the defendant. 22. Plaintiff no.1 is a corporation organized and existing under the laws of the United States of America at Colorado, USA and was founded in the year 2002. The founders namely Mr. Scott Seamans, Mr. Lyndon Duke Hanson and Mr. George Boedecker, Jr. introduced a simple, comfortable boat shoe in a unique form and design. Plaintiff no.1 claims to be a world leader in innovative casual wear for women, men and children. Its brands include CROCS and HEYDUDE. 23. Plaintiff no.2 is a subsidiary of plaintiff no.1. The plaintiffs are globally recognized for their iconic, innovative, and highly distinctive footwear designs. Since its inception, the plaintiffs have expanded their product offerings to include over three hundred distinct styles for men, women, and children. The plaintiffs' products have garnered tremendous goodwill and popularity across international markets, including in India. 24. Plaintiff no.1's footwear sold under the "CROCS" brand is claimed to CS(COMM) 388/2026 Page 3 of 22 This is a digitally signed order. The Order is downloaded from the DHC Server on 16/04/2026 at 21:05:30 be made up of proprietary materials known as "CROSLITE", proprietary cell- resin materials that gives each pair of shoes the soft, comfortable, lightweight and odour-resistant qualities. "HEYDUDE" is a footwear brand stated to be founded in Italy in 2008 and in just 30 months after the brand was founded, over one million shoes had already been sold in over 20 different countries. Crocs Inc. acquired the "HEYDUDE" brand and all its IP portfolio for USD 2.5 billion. 25. Plaintiffs claim that in the year 2006, plaintiff no.1 entered into a definitive agreement to acquire 100% of the membership interest in plaintiff no.2 specializing in accessories and customization items for CROCS footwear. Pursuant to this acquisition, 'JIBBITZ' has been integrated into plaintiff no.1's global commercial ecosystem. 'JIBBITZ' arose from the idea of personalizing the plaintiffs' footwear by designing decorative and colourful snap-on accessories that could be inserted into the ventilation holes of the plaintiffs' footwear. The concept quickly gained popularity, and today thousands of designs are sold across the world. 26. In para 14 of the plaint, the plaintiff has enlisted various awards, recognitions and awards received by it across the world. The details of sales of the plaintiffs for Crocs and Jibbitz products for the years 2017-18 was approximately Rs.157.48 crores and touched Rs.554.30 crores in the year 2024-25. The plaintiff asserts that the substantial sales as indicated above clearly evidence impeccable reputation and goodwill and also are reflective of the high quality of the products manufactured by it. It is also asserted that on account of long and extensive use and promotion of the products created by the plaintiffs, the products are capable of being identified and associated with the plaintiffs exclusively and no one else. 27. The plaintiff claims to be extremely cautious and vigilant in protecting the goodwill and reputation vested in the products of the plaintiffs. The plaintiffs claim that the aforesaid features are unique and bring a stylized look to the products which are distinctive. The product is original and unique as also synonymous with excellence in the quality of ingredients used, design, execution and aesthetics. Plaintiffs also claim that the defendant apart from infringing the plaintiffs' registered design also commits the tort of passing off. Plaintiffs also assert that the goodwill garnered through extensive advertisements, promotional activities would get diluted and tarnish the goodwill and reputation garnered over the years. It is also likely that the public would form an opinion of association between various competing products which would be unfair to the plaintiffs. 31. Plaintiff also asserts infringement of its patent rights in IN 271337 which is called Jibbitz patent. The bibliography of the said patent is provided in para 39 and is stated to be valid till 07.07.2026. The invention claimed relates to a proprietary system for attaching decorative accessories to footwear having expandable or stretchable holes. It is claimed that the suit patent covers the functional mechanism whereby accessories can be removable and secured through the shoe surface without compromising comfort or structure. Plaintiffs claim that the system for attaching a decorative accessory to a shoe having at least one expandable or stretchable hole, comprises the following as enumerated in para 41 of the plaint. (i) a shoe having at least one expandable or stretchable hole; (ii) a shaft having first and second ends; (iii) a first shoulder secured to the first end of the shaft, the first shoulder being configured for insertion through at least one expandable or stretchable hole and configured to engage an inner surface of the shoe; (iv) a second shoulder secured to the second end of the shaft, the second shoulder being configured to engage the shoe; (v) a decorative accessory at or adjacent the second shoulder. 33. Claim 1 of the patent is mentioned in para 42 and is not being reproduced hereunder. 34. Plaintiffs claim that sometime in October 2025, it learnt that the defendant is unauthorizedly using the plaintiffs' intellectual properties to sell its products across third party platforms such as Amazon and Flipkart. As such, the plaintiffs engaged the services of an investigator who completed the investigation in the month of March 2026. In support thereof, the affidavit of the investigator has also been filed along with the present suit. The investigation further revealed that the defendant is alleged to be infringing the Jibbitz patent by selling 'Charms' for its footwear which is a dishonest adoption of the patented system under the Jibbitz patent. The investigation has also claimed to have revealed certain instances of blatant trademark infringement by the defendant by the unauthorized use of the marks CROSLITE on third party listings which is extracted hereunder: 39. Predicated on the above, the plaintiffs seek ex-parte ad-interim injunction in respect of violation of its registered design, suit patent bearing IN 271337 and its registered trademarks including the 3-D shape mark bearing no. 435446 and mark CROSLITE. 40. This court has heard Mr. Pravin Anand, learned counsel for the plaintiff, perused the pleadings and examined the documents on record. 41. Since the matter relates to infringement of design registration, suit patent IN 271337 and trademark CROSLITE including the 3-D shape, it would be apposite to first set out the comparative table hereunder in seriatim: S.No PLAINTIFF NO.1 DEFENDANTS USE . 1. A perusal of the aforesaid table clearly sets out that not only is the defendant infringing the registered design of the plaintiffs but also the suit patent IN 271337 'JIBBITZ' and the trademark CROSLITE. It is evident from the aforesaid comparison that the defendant has slavishly copied the design of the plaintiffs in its entirety, without any modification or alteration whatsoever. Such blatant imitation is prima facie likely to cause confusion in the minds of unwary consumers of average intelligence, who may mistake the defendant's product for that of the plaintiffs. 43. The defendant is also stated to be operating a website www.solethreads.com apart from presence in social media platforms such as Instagram, Facebook, Twitter, YouTube and LinkedIn where the infringing products are on display. As of now, there appears to be no bona fide in the defendant adopting the design, trademark and the suit patent Jibbitz. The defendant seems to be copying the overall look and feel of the plaintiffs' product to encash the hard earned goodwill, reputation and success of the plaintiff. The comparison between the products indicates imitation of the plaintiffs' product by the defendant. In fact, the defendant is also copying the plaintiff's trade dress, get up which are pointers towards the defendant's attempt to cause confusion/deception. 44. The aforesaid infringements are likely to dilute the brand, goodwill and reputation garnered over the years by the plaintiff. The plaintiff has placed on record enough documentary evidence to evidence its registrations over the trademarks and design apart from the suit patent IN 271337 JIBBITZ which is valid till 07.07.2026. 45. In that view of the matter, the plaintiff has been able to establish a prima facie strong case in its favour and against the defendant. Having regard to the voluminous documents evidencing various registrations in trademarks, design and the suit patent coupled with the sales turnover and promotional CS(COMM) 388/2026 Page 19 of 22 This is a digitally signed order. The plaintiff shall suffer irreparable loss and injury which may not be compensated adequately in monetary terms in case ex-parte ad- interim injunction is not passed against the defendant. 46. Accordingly, the following directions are passed: a. Defendant, its partners, directors, principal officers, servants, agents, affiliates, subsidiaries, sister concerns, representatives and all others acting for and on their behalf are restrained from using from manufacturing, selling, offering for sale, advertising, importing, exporting, displaying, or in any manner dealing in any products, including footwear and accessories, which: i. Infringe the plaintiffs' registered designs bearing Nos. 357714-001, 369333-001 and 349374-001, or any other design which is identical with or an obvious or fraudulent imitation thereof till its validity; ii. infringe the plaintiffs' Indian Patent No. 271337, including by making, using, selling or offering for sale any products incorporating the patented system for attaching decorative accessories to footwear till its validity; iii. infringe the plaintiffs' registered trademarks, including the 3D shape mark bearing No. 4354468 ( ) and the mark CROSLITE bearing No. 1476423, or any other mark, shape, trade dress or identifier which is identical with or deceptively similar thereto. b. Defendant directed to forthwith take down/remove/disable access to all listings, advertisements and promotional materials relating to the impugned products, including on defendant's own website; CS(COMM) 388/2026 Page 20 of 22 This is a digitally signed order. Defendant is directed to maintain and preserve accounts, including books of accounts, sales records, stock details and all related documents, pertaining to the manufacture and sale of the impugned products. 47. Issue notice. 48. Let a reply to this application be filed by the defendant within four weeks from service. Rejoinder, thereto, if any, be filed within two weeks thereafter. 49. Compliance of Order XXXIX Rule 3 of CPC shall be done within ten (10) days from date. CS(COMM) 388/2026 50. Let the plaint be registered as a suit. 51. Upon filing of the process fee, issue summons of the suit to the defendant through all permissible modes. 52. The summons shall state that the Written Statement shall be filed by the defendant within 30 days from the date of the receipt of summons. Alongwith the Written Statement, the defendant shall also file Affidavit of Admission/Denial of the documents of the plaintiffs, without which the Written Statement shall not be taken on record. 53. Liberty is granted to the plaintiffs to file Replication, if any, within 30 days from the receipt of the Written Statement.
