Case of the Plaintiff as set out in the plaint is that Plaintiff is a Health Tech company, providing online health consultancy services and offers sale of nutraceutical/pharmaceutical products for different health concerns. Plaintiff was founded in 2022 and within a year of its establishment, it had reached a valuation of approximately Rs. 100 crores and as of January, 2026, Plaintiff is valued at over USD 169.82 million. Plaintiff is a well reputed and renowned name within the Health Tech industry and being a consumer centric brand, it aims for 100% satisfaction of its customers through a variety of goods and services in the field of medicinal and Ayurvedic preparations under its registered House mark 'POSITIVE GEMS/ ' and its various formative variants including Long Time, Stress Buster, Her Feelings, Re-grow, Energy Amrit, Get Wet CS(COMM) 335/2026 Page 3 of 25 This is a digitally signed order. It is stated that Plaintiff has partnered up with various logistics companies throughout the world and has established a widespread delivery network, which enables it to home-deliver its products to address each and every need of its consumers. Plaintiff has also established many Tele-health clinics to connect certified healthcare professionals digitally with the patients in order to devise and advise the best healthcare plans for them. Plaintiff endeavours to open around 1500 offline outlets across India in order to provide its invaluable experience and 24x7 services to its consumers. 22. It is stated that Plaintiff honestly and bonafidely coined and adopted the name/mark POSITIVE GEMS and registered the top-level domain name <positivegems.com>. In September, 2022, Plaintiff conceived the logo and has been using both word mark POSITIVE GEMS and device mark since then. Under the aegis of its exclusive house mark, Plaintiff introduced and has been manufacturing a new range of nutraceutical/pharmaceutical products to boost and nourish sexual health and wellness of its consumers. The mark POSITIVE GEMS is neither a dictionary word nor a generic term but is an original and unique creation of the Plaintiff and by virtue of extensive use and promotion, the trademarks POSITIVE GEMS/ have become uniquely and exclusively associated with the Plaintiff reflecting the extensive goodwill and reputation earned by Plaintiff's brand. It is stated that under its house mark POSITIVE GEMS/ , Plaintiff introduced a new range of nutraceutical/pharmaceutical products under various brands/formative marks including 'POSITIVE GEMS LONG TIME', 'POSITIVE GEMS STRESS BUSTER', 'POSITIVE GEMS RE-GROW', 'POSITIVE GEMS SHILAJIT', 'POSITIVE GEMS ASHWAGANDHA', 'POSITIVE GEMS GET WET LUBRI', 'POSITIVE GEMS ENERGY AMRIT', which boost and nourish sexual health and wellness of the consumers. 24. It is stated that Plaintiff has a top-level domain name registration for the domain name positivegems.com, which leads to a dedicated and interactive website www.positivegems.com, where its digital storefront is accessible to consumers and potential consumers not only in India but across the world. The said website serves as an official digital platform through which consumers and potential consumers can obtain detailed information about Plaintiff, its brand POSITVE GEMS and its wide range of nutraceutical and pharmaceutical products marketed under the marks POSITIVE GEMS and formative variants thereof as well as purchase such products directly. POSITIVE GEMS branded products are also sold through the Mobile Application owned and operated by Plaintiff under the name POSITIVE GEMS which displays the house mark POSITIVE GEMS/ and products are delivered by Plaintiff through the said application to customers pan India and in other jurisdictions. 27. It is stated that Plaintiff has spent substantial amount of money on promotion of its products in India, as a result of which sales and revenue figures of Plaintiff Company in India for the products sold, run into crores of rupees. It is stated that Plaintiff has built up considerable reputation and goodwill within the global as well as domestic market space through strategic alliances and global partnerships across the world. Plaintiff Company ranks among the top 100 partners of Bigfoot Retail, a billion- dollar company distributing over two lakh brands within India itself. With exclusive brand outlets and several others in pipeline across major cities like Delhi, Mumbai and Kolkata, Plaintiff has established a strong retail presence as well and its direct customer interaction through physical stores and an active online platform draws approximately 1.3 crore users annually, which reflects the widespread consumer trust in Plaintiff's brands. Plaintiff, in order to promote its products, regularly collaborates with public personalities to connect with the general public and public personalities such as Ms. Sunny Leone and Mr. Prem Chopra, and 200+ influencers have endorsed Plaintiff's brands and product range, thereby adding immense value to Plaintiff's brand equity within the Indian market. 29. It is stated that Plaintiff has also obtained several certifications to guarantee, ensure and maintain high product quality standard including the Drug License, Ayush License, Import-Export License and FSSAI License and Plaintiff's products are also registered with the Ministry of Consumer Affairs, Food and Public Distribution. It is stated that Plaintiff connects with its customers through social media networking websites such as Facebook and Instagram and has been featured/published in various articles and press releases, including but not limited to the Business Standard, Times of India, Economic Times, etc. Screenshot of the present number of followers on Plaintiff's social media pages as outlined in the plaint is as follows:- 31. It is stated that Plaintiff's dedication to the quality is evident through its collaborations with top-tier product quality and testing laboratories and product bearing Plaintiff's name undergoes testing by approved laboratories with reputation for testing products for renowned brands such as Tata, Mankind, and Reliance, Cipla, Pfizer, Dr. Reddy's and others. This commitment ensures rigorous third-party testing, benchmarking and multiple quality checks before products reach consumers. Furthermore, Plaintiff operates a 24x7 non-profit healthcare helpline staffed by professional's product experts, assisting over 10,000 individuals monthly, thereby reinforcing goodwill and public trust. 32. It is stated that sometime in December, 2025, Plaintiff came across a trademark application filed in the name of Defendant No.1, trading as M/s Easy Digital in respect of mark POSITIVE CURE/ CS(COMM) 335/2026 Page 11 of 25 This is a digitally signed order. Upon further investigation, Plaintiff came across a website operating under the domain name https://positivecure.in and corresponding website https://demo.easydigital.in/, which were being used by Defendant No. 1 for offering of sale, selling, marketing and advertising fake/counterfeit products under the marks 'POSITIVE CURE', / and even Plaintiff's own trademark POSITIVE GEMS/ . Defendant No.1 has also blatantly imitated the formative trademarks and trade dress/labels/packaging of Plaintiff's POSITIVE GEMS branded products including 'LONG TIME', 'STRESS BUSTER', 'RE-GROW', 'SHILAJIT', 'ASHWAGANDHA', 'ENERGY AMRIT', 'HER FEELINGS' and 'GET WET LUBRI'. Comparative tables of Plaintiff's registered trademark and Defendant No.1's marks as also Plaintiff's products and products bearing impugned marks and trade dress are as follows:- CS(COMM) 335/2026 Page 12 of 25 This is a digitally signed order. It is stated that Defendant No. 1 is on his website https://positivecure.in/ is selling, offering for sale, marketing and advertising its products under mark 'POSITIVE CURE' which is conceptually/deceptively similar to 'POSITIVE GEMS' mark. Defendant's impugned products bearing House mark 'POSITIVE CURE' is adopted in respect of identical products and have an identical trade channel due to which chances of confusion and/or deception are inevitable. It is stated that Defendant no.1 is also malafidely offering for sale and marketing counterfeit products on its website https://demo.easydigital.in/ under Plaintiff's registered house mark with exactly similar formative marks and trade dress i.e., POSITIVE GEMS GET WET LUBRI/ and POSITIVE GEMS ENERGY AMRIT/ . Having heard learned senior counsel for the Plaintiff and upon perusal of the documents, I am of the view that Plaintiff has made out a prima facie case for grant of ex parte ad interim injunction against Defendant No.1. Balance of convenience lies in favour of the Plaintiff and it is likely to suffer irreparable harm in case the interim injunction, as prayed for, is not granted. 37. Plaintiff is the registered proprietor of the marks aforementioned including the labels/packaging as aforementioned. Defendant No.1 is offering for sale, selling, marketing and advertising its identical/similar goods/counterfeit products using Plaintiff's registered marks/labels. The trade channels and consumer base are common and hence, confusion amongst members of the public is inevitable. Prima facie Defendant No.1 has attempted to come as close as possible to the Plaintiff to encash on its formidable goodwill and reputation and pass off its goods as those of the Plaintiff with a view to make unlawful monetary gains, thereby causing irreparable damage to the goodwill and reputation of the Plaintiff. Defendant No.2 is Meta Inc. and has been impleaded as infringing products are found on its social media platforms i.e. Facebook and Instagram. Defendant No.3 is the Domain Name Registrar of domain names <positivecure.in> and <Easydigital.in> registered by Defendant No.1 and Defendant No.4 is responsible for maintaining services including developing of website infrastructure which Defendant No.1 uses to create fake online stores with the aforesaid domain names. 38. Accordingly, till the next date of hearing, Defendant No. 1, its partners, proprietors, agents, servants, representatives, employees and/or anyone claiming under them, directly or indirectly, are restrained from:- a) Selling or offering for sale its products using Plaintiff's House CS(COMM) 335/2026 Page 21 of 25 This is a digitally signed order. Defendants No.3 and 4 are directed to lock, suspend and take down the website https://positivecure.in/ as also take down the following URLs of the website https://demo.easydigital.in/checkout/ wherein the impugned infringing/counterfeit products of the Defendants are listed, within 36 hours from the date of receipt of this order:- CS(COMM) 335/2026 Page 22 of 25 This is a digitally signed order. Plaintiff shall comply with the provisions of Order XXXIX Rule 3 CPC within a period of two weeks from the date of execution of the local commission. I.A. 8524/2026 (u/O XXVI Rule 9 and u/O XXXIX Rule 7 r/w Section 151 of CPC) 42. This application is filed on behalf of the Plaintiff seeking appointment of a Local Commissioner. 43. Upon hearing, the application is allowed. 44. Local Commissioner shall visit the aforesaid premises of Defendant No.1 and inspect and make an inventory of the infringing goods and thereafter seize and take them into custody all the counterfeit impugned products including any other incriminating material such as stationery, packaging, cartons, containers, display boards, sign boards, advertising material, machineries, dies or blocks, unfinished products etc. bearing impugned trademarks or any other trademark/label identical with or deceptively similar to Plaintiff's trademarks. The goods so seized shall be handed over to the Authorized Representative of Plaintiff on superdari with an undertaking that the same shall be produced in Court when directed. 46. Local Commissioner shall also inspect and seize the books of accounts, ledgers and stock registers relating to sale of the offending goods. 47. Local Commissioner along with the representative of the Plaintiff and/or counsel shall be permitted to enter the aforesaid premises by Defendant No.1. In case of any obstruction in execution of the commission, Local Commissioner will be at liberty to take assistance of SHO of the concerned police station, who on being contacted shall render complete assistance and cooperation. In case the premises are found locked, Local Commissioner will be at liberty to break open the locks. 48. Plaintiff shall serve a copy of this order upon Defendant No.1 along with paper book of the suit at the time of execution of the commission. Fee of the Local Commissioner shall be paid in advance by the Plaintiff. 50. Report shall be filed by the Local Commissioner within two weeks from the date of execution of the commission and Registry shall be informed of the execution of commission and the filing of the report, only after which summons will be issued to the Defendants. 51.
