This is an application filed by the plaintiffs under Section 151 of Code of Civil Procedure, 1908 (hereinafter referred to as ' CPC '), seeking exemption from advance service of the paper-book upon the defendant no.1. 2. Mr. Ramesh N. Keswani, learned counsel for the plaintiffs submit that there is a real and imminent likelihood that the defendant no.1 may take immediate steps to dispose of, conceal or suppress its infringing business operations bearing the deceptively similar trademark. 3. Present application has been filed on behalf of the plaintiffs under Order XXXIX Rules 1 & 2 of CPC , 1908, seeking ex-parte ad-interim injunction against the defendants. 6. This is a suit instituted by the plaintiffs in respect of the estate of late Sh. Jamnadas Dharmani, the father of the parties, who is stated to have expired intestate in the year 1995. The suit also is in respect of the estate left by late Smt. Vidya Dharmani, the mother of the parties, by virtue whereof the three plaintiffs and the brother, i.e., defendant no.1 are claimed to be entitled to 1/4th share in the estate of the parents. It is stated that Smt. Vidya Dharmani expired on 03.07.2026 intestate. 7. It is further stated that the investments of the parents across the entirety of bank deposits, fixed deposits, Kuber Yojana deposits and mutual funds investments, devolved equally upon each of the plaintiffs as also the defendant no.1. It is further stated that so far as the knowledge of the plaintiffs goes, no Will has ever been executed by either late Sh. Jamnadas Dharmani or late Smt. Vidya Dharmani. It is also stated that late Sh. Jamnadas Dharmani was owner of CA-12, Tagore Garden, New Delhi-110027, which also has devolved upon them in equal shares and each of them is in constructive possession of the same. 8. It is also further stated that as on date, the plaintiffs seek an ex-parte ad-interim injunction against the defendant no.1 from liquidating any of the properties whether movable or immovable or liquid. The plaintiffs also state that the defendant no.1 is a nominee in the bank accounts etc., named above and as such holds the funds in a fiduciary capacity and as a trustee, thus, is estopped from liquidating or wasting the suit properties. 9. In view of the above and as also to ensure that the estate of late Sh. Jamnadas Dharmani and late Smt. Having regard to the above, issue notice. 11. Notice is accepted by Mr. Vishvendra Singh and Mr. Balvinder Ralhan, learned counsel appearing on advance notice for the defendant nos.4 and 10 respectively. Reply be filed within four weeks from date. 12. Issue notice to all the remaining defendants as well. 13. Reply be filed within four weeks from the date of service. 14. Rejoinder thereto, be filed within four weeks thereafter. 15. List before the Joint Registrar (Judl.) on 28.09.2026 for completion of service and pleadings. 16. Mr. Vishvendra Singh, learned counsel for the defendant no.4 and Mr. Balvinder Ralhan, learned counsel for the defendant no.10 accepts summons and waive issuance of the formal summons to the defendant nos.4 and 10 respectively. 21. Written statement shall be filed by defendant nos.4 and 10 within 30 days from date. 22. Upon filing of the process fee, issue summons of the suit to the remaining defendants through all permissible modes. 23. The summons shall state that the written statement shall be filed by the defendants within 30 days from the date of the receipt of summons. Alongwith the written statement, the defendants shall also file affidavit of admission/denial of the documents of the plaintiffs, without which the written statement shall not be taken on record. In case any party is placing reliance on a document, which is not in their power and possession, its details and source shall be mentioned in the list of reliance, which shall also be filed with the pleadings. 26. If any of the parties wish to seek inspection of any documents, the same shall be sought and given within the prescribed timelines. 27.
