This suit is instituted on behalf of the Plaintiffs inter alia seeking a decree of permanent injunction restraining the Defendant and all others acting on its behalf from manufacturing, trading, supplying, selling, marketing in any manner including online sale of goods bearing Plaintiff No. 1's HERO trademarks including device marks, amounting to infringement. 2. During the pendency of the suit, parties have amicably settled their inter se disputes and terms of settlement are incorporated in Settlement Agreement dated 10.03.2026, copy of which has been placed on record. 3. Court has perused the terms of settlement and finds the same to be CS(COMM) 738/2025 Page 1 of 2 This is a digitally signed order. Accordingly, the suit is decreed in terms of the Settlement Agreement, which shall form a part of the decree and terms thereof shall bind the parties thereto. 4. Registry is directed to draw up the decree sheet. 5. Learned counsel for the Plaintiffs submits that as agreed between the parties, Court may direct release of the goods seized by the Local Commissioner to the Defendant, which shall within 30 days permit inspection of the goods to the Plaintiffs' representative and hand over the counterfeit/infringing goods to the Plaintiffs for destruction. Responding to this, learned counsel for the Defendant submits that period of 30 days be extended by another 30 days to comply with the agreed terms, to which counsel for Plaintiffs, on instructions, has no objection. 6. With the consent of the parties, Local Commissioner appointed vide order dated 21.08.2025 is directed to release the seized goods from his custody and hand over the same to the Defendant in presence of representative of the Plaintiffs, whereafter the representative shall carry out inspection and the infringing/counterfeit goods will then be handed over to the Plaintiffs' representative for destruction. The entire exercise will be completed within 60 days from today. 7. Suit stands disposed of along with pending application. 8.
