Ms.Athira, learned Counsel, appears for the Petitioner and submits that the plaint in the proposed Suit has now been amended to include averments with respect to Clause XII of the Letters Patent Act, 1865, and has been inserted as Rider-A and newly added paragraph 117A. Referring to paragraphs 117 and 117A of the plaint in the proposed Suit and paragraphs 5 to 11 of the Petition, Ms.Athira avk 1/2 3-LPETN(L)-21290-2026.doc submits that although a substantial part of cause of action has arisen within the jurisdiction of this Court, however, since the Defendants no.6, 7, 8 and 9 are outside the jurisdiction of this Court and the addresses of the Defendants no.11 to 13 are not known, it is possible that a part of cause of action would have arisen outside the jurisdiction of this Court and with leave granted, this Court would have jurisdiction to entertain, try and dispose of the Suit. 3. Having heard the learned Counsel and having considered the submissions and having perused the said paragraphs, this Court is of the view that leave under Clause XII of the Letters Patent Act, 1865 be granted in terms of prayer clause (a) which reads thus : "(a) Grant leave under Clause XII of the Letters Patent to institute the present Suit against the Respondents before this Hon'ble Court." 4.
