Learned counsel for the plaintiff submits, that as narrated in the application, in the course of the search conducted by the plaintiff, it transpires that the GST number appearing on the invoices for sale of the infringing products under the impugned trademark, is registered in the name of Mr. Surjit Singh, who is impleaded as defendant No.2 in the present proceedings. It is submitted that the plaintiff has found that M/s Dashmesh Medicos is the proprietorship concern of the newly impleaded defendant No. 2. 18. It is accordingly submitted, that in view of the Mr. Surjit Singh being the father of defendant No.1, it is evident that both defendants are operating in a coordinated manner and are carrying-out the impugned activities collusively. 19. In the circumstances, attention is drawn to order dated 21.01.2026 to submit, that the purport of that order was to restrain the original defendant and all persons acting on his behalf from using the impugned trademark 'Noventis', since that trademark is deceptively similar to the registered trademark of the plaintiff i.e., 'Novartis'. 20. It is accordingly submitted, that it be clarified that order dated 21.01.2026 applies and extends to the newly impleaded defendant No.2 as well. 21. Issue notice. 22.
